This document sets out the terms under which musical content may be uploaded to the Scotland Rock's web site by individuals or organisations other than direct representatives of Scotland Rock's. By uploading musical content to the Scotland Rock's Web Site and servers you declare that you have read and understood the terms under which you have waived the right to collect copyright fees on broadcast of your material. In addition by completing the process of uploading musical content you accept all legal liability for claiming that you are in fact the individual, agent or representative of the individual, group or organisation to whom the legal intellectual property rights belong. Scotland Rock's and or any of its staff or representatives will not be liable or held as liable for checking the validity of your right to claim ownership of intellectual property rights and any dispute arising between parties will be dealt with under the terms detailed in our Acceptable Use Policy and Terms of Use.
In granting permissions for the following uses of your copyrighted material. You are not assigning or transferring any of your actual rights to the intellectual property and still retain full ownership of said rights. You are only granting permission for the following uses and only those uses which you explicitly agree consent for. If at any point in the future you choose to review your position on the granting of these permissions. Then upon notifying Scotland Rock's by either the internal systems used on the web site or by contacting Scotland Rock's in writing on your official letterhead we will remove your copyrighted material from our servers and notify all registered Scotland Rock's users of your material about this change in the manner as set out in our Acceptable Use Policy and Terms of Use.
By agreeing to this during the completion of the upload process or by sending content via e-mail you agree to indemnify Scotland Rock's from liability to pay ALL types of copyright fee's on the material you upload or send direct to us. This includes but is not limited to the rights for the musical works, the sound recording and the ephemeral or mechanical copyright. This indemnity from liability to pay copyright fee's will pertain to all broadcasts created and directly controlled by Scotland Rock's or its staff.
Whereby the broadcast is directly or indirectly transmitted via a third party commercial distribution network. That in whole or part charges a fee or in some other way collects copyright fee's for the material broadcast through its network. They shall not be protected by this waiver of copyright fee's from paying fee's collected on your musical works. This includes but is not limited to the broadcasts through Live365.com who collect a Royalty Administration Fee as detailed on our copyrights page regardless of any waivers agreed.
Although the above text sets out under what terms Scotland Rock's will broadcast uploaded material it does not limit in any way Scotland Rock's or its representatives right's to choose not to program your material on its broadcast. It does not constitute a contract or guarantee to promote you, your music or your musical project in any manner whether directly through its Internet Radio broadcasts or by any other means. It does not exhaustively detail every possible definition or right to claim intellectual property copyrights, but merely attempts to set out a basis for which All parties involved may share use of their creative works in a manner that is beneficial to ALL.
Whereby any point not specifically described here. Scotland Rock's Acceptable use Policy and Terms of Use will be the basis for which any decision is made and although this is a specific guide pertaining to the waiver of liability to pay copyright fee's it in no way supersedes or replaces our Acceptable Use Policy and Terms of Use.
This document is due to be revised again on or just after January 1st 2007.
